During a crisis, the typical federal balance of power undergoes a radical shift to ensure a unified command.
In normal times, India operates as a federal system where the states and Center share power. However, during an Emergency, the Central government becomes supreme. The states fall under total control of the Center, effectively turning the nation into a unitary state without a formal Constitutional amendment.
The Constitution provides for three distinct types of emergencies, each tailored to specific threats.
This is the most severe form, triggered when the security of India or a part of it is threatened. It is the only type officially termed a ‘proclamation of emergency’ in the Constitution.
Commonly referred to as President's Rule, this occurs at the regional level. Interestingly, the word "emergency" is not used in the technical phrasing of Article 356.
This provision is invoked when the very foundation of India's economy is perceived to be at risk.
